Terms of Use – Purchases from the MOMus Online Store

The website shop.momus.gr is the online store for displaying and selling products from the “Metropolitan Organization of Museums of Visual Arts of Thessaloniki – MOMus”. Browsing and using the website shop.momus.gr implies your explicit and unconditional acceptance of the following terms.

MOMus reserves the right to modify or update these terms and conditions of transactions made through its online store at any time, whenever deemed necessary, without prior notice, except by posting updates on this website.

Product Information & Availability

MOMus makes every reasonable effort to ensure that the information and descriptions of products available through the website shop.momus.gr are as complete and accurate as possible. However, MOMus is not responsible if any information or description related to its products sold online is inaccurate, incomplete, outdated, or contains errors, which may have reasonably escaped attention or resulted from unintentional mistakes or disruptions in the website’s operation, due to unforeseen events or force majeure.

The shop.momus.gr cannot guarantee the availability of all its products at all times, but is obliged to promptly inform the end consumers about their unavailability.

Limitation of Liability

The online store shop.momus.gr is not liable for any civil claims, especially for compensation of damages (whether direct or indirect, including but not limited to lost profits, monetary satisfaction, etc.), which may be caused to visitors of the website or third parties, arising from issues related to the website’s operation, product or service availability, or any unauthorized third-party interventions in the provided services, except in cases of deliberate actions or gross negligence.

Intellectual Property Rights

The website shop.momus.gr is part of the official online presence of MOMus. The content posted on the website by MOMus, including (but not limited to) texts, images, services, and products, is considered intellectual property of MOMus and is protected by relevant Greek, EU, and international intellectual property laws.

Any reproduction, republication, download, announcement, distribution, transmission, or any other use of the website’s content for commercial or other purposes is permitted only with prior written permission from MOMus or any legitimate holder of the intellectual property rights.

The names, images, logos, and other distinguishing features representing MOMus and its online store, as well as its products or services, are exclusively trademarks of MOMus and shop.momus.gr and are protected by Greek, EU, and international trademark and unfair competition laws. In any case, the appearance of these trademarks on the website does not imply a transfer or granting of rights for their use or exploitation.

User Responsibility

Users of the shop.momus.gr online store agree not to use the website to send, post, announce, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, offensive, obscene, libelous, discriminatory, or otherwise violates the rights of others or causes harm in any way.

The shop.momus.gr does not control the availability, content, privacy policy, quality, or completeness of the services of other websites and webpages to which it links via hyperlinks or advertising banners. Therefore, for any issues arising during the visit/use of these sites, the user must directly contact the respective websites and pages, which bear full responsibility for the provision of their services.

The shop.momus.gr should under no circumstances be considered as accepting/approving the content and services of the websites and webpages to which it links, nor should it be considered as being connected to them in any other way.

Product Purchases

  1. Upon placing an order, you will receive an automated email with the details of your order.
  2. After processing, you will receive a second email confirming the exact products that will be shipped.
  3. Throughout the order process, you will receive a series of automated emails that will update you on the progress of your order. If there are any issues with your order, we will send you an email or contact you by phone, using the contact details you provided upon registering on our website.
  4. In case there is any pending issue with your order, an appropriate email will be sent to you, or we will contact you via the phone numbers you provided during registration on our website. There is no way to deactivate these notifications, as sending them is a prerequisite for the proper processing of your order. We ask that you ensure these emails can reach you and that you keep them throughout our transaction. It is your responsibility, in case you do not receive the relevant emails, according to the general terms governing our transactions, to inform us without delay.

Return Process

You have the right to return the products you purchased and request a replacement in the following cases:

a) In all cases where, due to proven fault of MOMus, you were delivered products different from those you ordered.

b) In all cases where there is a genuine defect in the product, provided that no different terms are specified by the warranty of the manufacturer or importer, and the product is still within the warranty period, in which case the terms of the warranty apply, or if no warranty exists.

Specifically, you have the right to return the products you purchased and request an exchange for another product or products up to the value of the price you paid, or with an additional fee if desired, within fourteen (14) days from the receipt of the product. In any case, please contact us beforehand at (tel. 2310589229).

In all cases, the product to be replaced must be accompanied by the original proof of purchase and must be in the condition in which it was received by the customer, complete and without damage. The packaging must be the one that originally accompanies the product and in excellent condition, along with all the documents that accompany it (e.g., invoice, receipt, etc.). In any other case, MOMus reserves the right not to accept the return of the product.

Before any return, prior communication with MOMus is required.

Return Process

In case a product is defective (e.g., broken or worn out) or does not match your order (e.g., incorrect product delivered), you can return it to MOMus headquarters using the courier service associated with MOMus, following instructions from shop@momus.gr. In such cases, send an email to shop@momus.gr with the subject “RETURN – ORDER NO.*” and attach photos of the product.

Then, you will receive in response to the above email with specific return instructions. Subsequently, MOMus will process the return of your money using the same payment method that was used for the purchase of the product, within 30 days from the product’s delivery to MOMus headquarters, provided that the above conditions are met. MOMus is not responsible in case of delays in crediting the amount to the customer’s account due to reasons beyond its control and related to the (mal)function of the respective financial institution.

You will not be charged return costs for the aforementioned cases (wrong product delivery or defective product delivery).

Right of Withdrawal

Additionally, you have the right to withdraw from the remote sales contract/sale without justification, within 14 days from the day you acquire physical possession of the product, under the terms and consequences outlined in Article 3e et seq. of Law 2251/1994, as codified by Ministerial Decision 5338 (Government Gazette B’ 40/17.1.2018) and in effect today. For your unjustified withdrawal, you can use the withdrawal form which can be sent to us at info@momus.gr, or included with the returned product when sending it back.

Furthermore, the products to be returned must be in excellent condition, completely undamaged, within their original packaging, and always accompanied by the purchase invoice or the corresponding retail receipt.

In any other case, MOMus reserves the right not to accept the return of the product.

Returned products are shipped at the customer’s own risk. In any case, the customer is responsible for the return shipping costs and any reduction in the value of the product. MOMus explicitly reserves the right to assess any such reduction in value upon receiving the returned product. The obligation to refund will be fulfilled without undue delay and within 30 calendar days from the return of the product.

MOMus will process the refund using the same payment method that was used for the purchase of the product within 30 days from the delivery of the product to MOMus’s premises, provided that the above conditions are met. MOMus is not responsible for any delays in crediting the payment to the customer’s account due to reasons beyond its control, including issues related to the (mal)functioning of the respective financial institution.

Please note that in the case of a return due to your withdrawal, you will be responsible for the return shipping costs, and the original shipping fees will not be refunded

The right of withdrawal under the provisions of Law 2251/1994 does not apply in the following cases:

Order Cancellation

Cancellation of the order can only be done in the following case: You must send an email to us, shop@momus.gr by 3:00 PM on the day of the order, providing your details and the order number. A member of our team will take care of the cancellation.
